These Terms of Service ("Terms") constitute a legally binding agreement between you and Novatrax Global LLC ("Company," "we," "our"), the developer and operator of the OutsideSafe mobile application and website at outsidesafe.com ("Service"). By accessing or using the Service, you confirm that you are at least 13 years of age, have legal capacity to enter these Terms, and agree to comply with them and our Privacy Policy. We reserve the right to modify these Terms at any time. Continued use following notice of changes constitutes acceptance.
OutsideSafe is an outdoor safety intelligence application that aggregates environmental data from third-party sources including the US Environmental Protection Agency (EPA AirNow), PurpleAir sensor network, Ambee pollen data, Open-Meteo forecast API, and OpenWeatherMap. The Service calculates an Outdoor Safety Score and provides AI-powered guidance through the Sky AI feature. OutsideSafe operates as an informational tool and does not replace professional medical advice, emergency services, or official government safety guidance.
To access certain features, you must create an account with accurate, current, and complete information. You are responsible for all activities under your account.
Subscriptions are processed through Apple's App Store. Payment is charged to your Apple ID at confirmation. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel through App Store settings.
All purchases are subject to Apple's standard refund policy. To request a refund, contact Apple at reportaproblem.apple.com. Novatrax Global LLC does not independently process refunds.
We may offer free trials. At the end of any trial, your subscription will convert to paid unless cancelled before the trial ends.
The free version provides the Outdoor Safety Score, basic pollen level, AQI, UV, smoke data, basic Smart Alerts, limited Ask Sky questions, and one saved location. Sky Pro subscribers receive all 15 features including unlimited Ask Sky, full pollen intelligence, Best Window Planner, Dog Mode, People & Pets, Activity Advisor, Trust Check+, Sky Watch, Outdoor Plan Score, Open Window Mode, Travel Mode, Weekly Sky Report, Smart Alerts Pro, unlimited saved locations, and the complete Outdoor Profile system. Feature availability subject to change with reasonable notice.
We collect the following to provide and improve the Service:
We do not sell your personal data to third parties. We do not use health sensitivity data for advertising. Data is encrypted at rest using industry-standard practices.
OutsideSafe requests location access to provide accurate local outdoor safety scores. You may grant precise location, background location for alerts, or use only manually saved locations. Precise location is not stored permanently — only city/region is saved. You can disable location access at any time through device settings.

You are granted a limited, non-exclusive, non-transferable licence for personal non-commercial use. You may not copy, modify, reverse-engineer, or distribute the Service without written permission.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. Environmental data is sourced from third-party providers. We do not guarantee accuracy, completeness, or timeliness of such data. Outdoor conditions can change rapidly.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOVATRAX GLOBAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, HEALTH OUTCOMES, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
These Terms are governed by the laws of the State of Texas, United States of America. Any disputes shall be resolved through binding arbitration in Texas, except either party may seek injunctive relief in court. You waive any right to participate in class-action litigation against Novatrax Global LLC.
We retain account data as long as your account is active. You may request deletion at any time by contacting info@outsidesafe.com. We process deletion requests within 30 days. Some data may be retained for legal compliance or fraud prevention.
We share data only with: cloud infrastructure (Supabase, Vercel), AI inference providers for Ask Sky (Groq), environmental data APIs (EPA AirNow, PurpleAir, Ambee, Open-Meteo), and payment processors (Apple App Store / RevenueCat). We do not sell personal data. We do not share health sensitivity data with insurers, employers, or data brokers.
OutsideSafe is not directed to children under 13. We do not knowingly collect personal information from children under 13. Contact us immediately if you believe we have inadvertently collected such information.
Depending on your jurisdiction, you may have the right to access, correct, delete, or port your personal data. California residents have rights under CCPA. EEA residents have rights under GDPR. Contact info@outsidesafe.com to exercise these rights.
We implement industry-standard security including TLS encryption in transit, encrypted storage at rest, secure authentication, and access controls. No electronic transmission is 100% secure; we cannot guarantee absolute security.
We may update this Privacy Policy. We will notify you of material changes via in-app notification or email. Continued use constitutes acceptance of the updated policy.
